Consider the following tort claim recommended for approval: Shawn and Helen Donley in the amount of $540.78, and approve the resolution authorizing the filing of a Friendly Suit and confessing judgment in said amount. 8. Consider the following tort claim recommended for denial: Ruby Polk in the amount of $30,303.80. 9. Consider accepting a deed to Lots 17 through 32, Block 63, of the Lawton Heights Addition, commonly known as Lots 3 and 4, Block 63, Lawton Heights Addition, accepting payment of $5,000.00 and approve dismissing the pending action in the District Court of Comanche County titled City of Lawton, Oklahoma, A Municipal Corporation vs. Transforming Hand, Inc, et al, Case No. CJ-2025-265. 10. Consider approving a resolution amending the City of Lawton FYE26 budget, as amended, to appropriate $1,269,403.92 in insurance proceeds to the General Fund for the repair of city facilities, $1,525,706.00 to the General Fund for the Elmer Thomas Park Amphitheater and Lake Helen Boardwalk design, and $8,374.35 to the 2019 Capital Improvement Fund for the payment of final invoices relating to the PW2101 Landfill Cells 6 & 7 project. 11. Contingent upon state approval through the Roof Assent Management Program, consider awarding a construction contract to Clayco Industries Inc., Doing Business As Ford Roofing & Sheet Metal co. in the amount of $512,392.52 to replace the roof of McMahon Memorial Auditorium which was damaged during the 2023 hail storm, and authorize execution of necessary documents. 12. Consider and take action in approving Change Order no. 1 reducing the contract by $276,662 and accepting the project in the final contract amount of $3,788,119.70 and placing the maintenance bond into effect for the South Wolf Creek Trunk Expansion #5 Project PU1801 as constructed by McKee Utility Contractors, LLC. 13. Consider awarding (CL26-002) Agricultural Leases to the named parties in the attached memorandum from the City Attorney’s Office, with each award contingent upon the lessee executing a timely lease with the City and authorizing the Mayor and City Clerk to execute the required documents. 14. Consider and take action in approving Change Order no. 1 reducing the contract by $395,579.00, accepting the project in the final contract amount of $3,975,441.00, and placing the maintenance bond into effect for the Sub Basin 104, 105, 106 Projects PU1306 PU1410 PU1414 for sewer line replacement as constructed by Horseshoe Construction, INC. 15. Consider approving final change order No. 1 with an overall deduction of $73,344.25 for Project PW2505- Emergency Landfill Repairs, as constructed by 4X Construction Group, LLC, thereby placing the Maintenance Bond into effect. 16. Consider and take action in approving Change Order no. 2 reducing the contract by $24,033.81 and accepting the project in the final contract amount of $14,353,226.19 and placing the maintenance bond into effect for the Map 9 Waterline Replacement Project PU2308 as constructed by TIMCO Blasting & Coatings, INC. 17. Consider approving and issuing a Revocable Communications Cable Permit to Chickasaw Telecommunications Services Inc. to install approximately 123 feet (7.45) rods of fiber optic cable within the right of way of E Gore Blvd to serve the Arvest Bank located at 2902 E Gore Blvd. 18. Consider approving a Revocable Communications Cable Permit with Indian Nations Fiberoptics, Inc. for five existing routes within the City of Lawton, and authorizing the Mayor and City Clerk to execute the document. 19. Acceptance of a donation from the Thunder Community Foundation for the refurbishment of a basketball court at Lee West Park in the amount of $21,360.00. 20. Consider designating the area immediately around the Comanche Nation Education Center as a school zone and implement traffic control measures accordingly. 21. Consider approving the claims list from September 6, 2025, through September 19, 2025. 22. Consider approving proposed appointments to boards and commissions. 23. Consider approving a second amendment to the School House Slough lease agreement as it pertains to the location of the proposed self-serve ice vending machine. Unfinished Business 24. Receive an updated presentation from Family Promise regarding their request for Community Housing Development Organization (CHDO) Project for the acquisition and rehabilitation of building and property located at 1308 SW D Avenue and authorize the Mayor and City Clerk to sign all required documents pertaining to this project. Business Items 25. Hold a public hearing and consider approving the Amendment to the Annual Action Plan for FFY 2025 and authorizing the Mayor and City Clerk to execute the revised SF 424s and Grant Funding Agreements for CDBG & HOME along with any other documents necessary to implement the plan document. 26. Hold a Pubilc Hearing and consider approving the Amendment to the consolidated Action Plan for FFY 2021-2025 and authorizing the Mayor and City Clerk to execute the revised SF 424's and Grant Funding Agreements for CDBG along with any other documents necessary to implement the plan amendment. 27. An ordinance amending Personnel Policies and Procedures Section 17-1-3- 127, Division 17-1-3, Article 17-1, Chapter 17, Lawton City Code, 2015 by clarifying the amount of time an employee must give before separation from employment to be eligible for rehire; removing language that allowed leave to be taken during the notice of separation time frame; providing for severability and establishing an effective date. 28. An ordinance amending Personnel Policies and Procedures Section 17-1-4- 440, Division 17-1-4, Article 17-1, Chapter 17, Lawton City Code, 2015 by amending the notice time a general employee shall provide prior to separation from service; by adding that if an employee submits a notice of separation for a specific date, management may shorten the time for the good of the service; renumbering this section of code to correspond to the numbering where it belongs; providing for severability and establishing an effective date. 29. An ordinance amending Personnel Policies and Procedures Section 17-1-6- 167, Division 17-1-6, Article 17-1, Chapter 17, Lawton City Code, 2015 by correcting code to reference general employee instead of executive employee as it pertains to the pay plan; providing for severability and establishing an effective date. 30. An ordinance amending Personnel Policies and Procedures Section 17-1-6- 163, Division 17-1-6, Article 17-1, Chapter 17, Lawton City Code, 2015 by clarifying code and the meaning of "immediately prior to separation of city employment"; adding a paragraph stipulating the forfeiture of unused sick leave if proper notice was not given; renumbering of specific paragraphs due to the addition; providing for severability and establishing an effective date. 31. An ordinance amending Personnel Policies and Procedures Section 17-1-7- 173, Division 17-1-7, Article 17-1, Chapter 17, Lawton City Code, 2015 by amending code to say that a witness will be present if an employee is issued a written warning or written reprimand; specifying the timeframe in which an employee suspension must start; amending the processes that must be followed to discipline an employee with either suspension, demotion or termination; Adding a section pertaining to merit step increases after being suspended or demoted; providing for severability and establishing an effective date. 32. An ordinance amending Personnel Policies and Procedures Section 17-1-6- 168, Division 17-1-6, Article 17-1, Chapter 17, Lawton City Code, 2015 by amending code to say that an employee that submits to a random drug screen or a for-cause drug screen, whose results are reported as positive, will be placed on administrative leave without pay pending a meeting and will remain on said leave pending any disciplinary action that may be taken; providing for severability and establishing an effective date. 33. Consider approving an ordinance pertaining to recreation, amending Section 19-3-302, Article 19-3, Chapter 19 of the Lawton City Code 2015, relating to fishing permits required, by changing the age requiring a permit to fish Lawton lakes Ellsworth and Lawtonka from 16 to 18, providing for severability and establishing an effective date. 34. Consider approving an ordinance pertaining to recreation, amending Section 19-2-207, Article 19-2, Chapter 19 of the Lawton City Code 2015, relating to water sports and boating license expiration to the end of the calendar year, providing for severability and establishing an effective date. 35. An ordinance pertaining to recreation, amending Section 19-6-606, Article 19- 6, Chapter 19, Lawton City Code 2015, relating to golf carts and land recreation vehicles permitting, by changing golf cart/land recreational vehicle permit expiration to the end of the calendar year, restricting golf cart access on the road serving the ponds, providing for severability and establishing an effective date. 36. Consider approving an ordinance modifying the title to Article 20-2, modifying Sections 20-2-202 through 20-2-207, 20-2-209, 20-2-210, and 20- 2-212, and creating Section 20-2-212.1, Article 20-2, Chapter 20, Lawton City Code, 2015 pertaining to excavating and/or boring within street rights-of-way or public easements including paving cuts by requiring a paving cut/excavation/boring permit for such work; providing for severability and codification. 37. Consider approving an ordinance creating Division 6-6-3, Article 6-6, Chapter 6, Lawton City Code, 2015 and creating Sections 6-6-3-601, 6-6-3-602, 6-6-3- 603, 6-6-3-604, 6-6-3-605, 6-6-3-606 6-6-3-607 and 6-6-3-608 in said Division establishing that an excavation/boring contractor's registration is required to obtain a paving cut/excavation/boring permit; providing for severability and codification. 38. Consider approving a resolution amending Appendix A, Schedule of Fees and Charges, and Appendix B, Bond Schedule, Lawton City Code, 2015, pertaining to Article A-20-2, Chapter 20, Paving Cuts and Excavations, by adding a fee for boring permits under or within street rights-of-way or public easements; establishing a fee in Article A-6-6 pertaining to contractor’s registration by creating an annual and renewal fee for such registration; and establishing a surety bond amount for excavation/boring contractors by creating Article B-6-6-3-605. 39. Consider approving an ordinance modifying Sections 20-4-402, 20-4-403, and 20-4-405, Article 20-4, and rescinding Figure 1, Chapter 20, Lawton City Code, 2015 pertaining to Revocable Communications Cable and Pipeline Permit by updating where such permits are applied for and modifying that the revocable permit is for an indefinite term until said permit is terminated or revoked; providing for severability. 40. Consider approving a resolution amending Appendix A, Schedule of Fees and Charges, Lawton City Code, 2015, pertaining to Article 20-4, Chapter 20, Revocable Communications Cable and Pipeline Permit, by modifying that the annual fee is a use fee and not a review fee and by establishing an inspection fee for any requested or required inspection outside of the initial construction. 41. Consider suspending approvals of new fiber installation from any company that has not submitted surveyed record as-built drawings for review and approval in accordance with their agreement/permit, and also consider rescinding any approvals for fiber installation that has yet to be installed until such time the required surveyed record as-built drawings have been submitted and approved. 42. Discuss Artifical Intelligence’s CDBG Homelessness Reduction Plan for Lawton Residents and take action as deemed necessary. 43. Consider approving an ordinance creating Division 16-3-2 in Article 16-3, Chapter 16, Lawton City Code, 2015, and creating Sections16-3-2-201, 16-3- 2-202, 16-3-2-203, 16-3-2-204, 16-3-2-205, 16-3-2-206 and 16-3-2-207 in said Division for the purpose of protecting public health, safety and welfare by prohibiting unauthorized camping, providing for the removal of unattended personal property, defining certain terms, providing for enforcement and penalties, regulating the storage of certain personal property recovered from public property within city limits, providing for an administrative appeal process for property removal, providing for exceptions, providing for coordination with social services; repealing and reserving Section 16-3-1-326 of Division 16-3-1, Article 16-3, Chapter 16, Lawton City Code, 2015; providing for severability, codification and declaring an emergency. 44. Executive Session 47. Consideration, discussion and possible action to enter into executive session to hold confidential communications between the City Council of the City of Lawton and its attorney concerning the settling of certain claims in pending litigation (City of Lawton v. Purdue Pharma L.P., et al, Case No. 1:19-op- 45500-DAP, pending in the United States District Court for the Northern District of Ohio, and related litigation), including potential resolution of certain claims against Purdue Pharma LP and its affiliated entities in Purdue Pharma LP’s bankruptcy case (Case No. 7:19-bk-23649 pending in the United States Bankruptcy Court for the Southern District of New York), members of the Sackler family (the “Sackler’s”), Alvogen, Inc., Amneal Pharmaceuticals, Inc., Apotex, Inc., Hikma Pharmaceuticals USA, Inc., Indivior Inc., Mylan Pharmacetucials Inc., Sandoz, Inc., Sun Pharmaceutical Industries, Inc., and Zydus Pharmaceuticals, related to lawsuits against pharmaceutical supply chain participants of opioid prescription drugs, and taking appropriate action in open session, including possible authorization to settle claims, the disclosure of which may seriously impair the litigation if known by public disclosure as allowed by 25 O.S. § 307(B)(4). 48. Pursuant to Section 307B.1, Title 25, Oklahoma Statutes, consider convening in executive session to review the employment of John Ratliff as City Manager, and in open session take other action as necessary. Audience Participation Lawton citizens who have completed a Request to Speak Form and wish to address business not listed on the agenda may step forward at this time. To ensure compliance with the Oklahoma Open Meeting Act, the Mayor and Council will receive comments but will NOT engage in direct responses. However, they may refer matters to the appropriate department or individual for further consideration and follow-up action. To participate, speakers must submit a Request to Speak Form to the City Clerk and reside within the Lawton city limits. Each speaker is allotted 3 minutes, with a maximum of 9 minutes per topic, and Audience Participation is limited to 30 minutes total. All participants are expected to follow the Rules of Decorum as outlined in Council Policy 1-6. Adjournment The City of Lawton encourages participation from all of its citizens.
