Reports: Mayor/City Council/City Manager Audience Participation Lawton citizens who have completed a Request to Speak Form and wish to address business not listed on the agenda may step forward at this time. To ensure compliance with the Oklahoma Open Meeting Act, the Mayor and Council will receive comments but will NOT engage in direct responses. However, they may refer matters to the appropriate department or individual for further consideration and follow-up action. To participate, speakers must submit a Request to Speak Form to the City Clerk and reside within the Lawton city limits. Consent Agenda The following items are considered to be routine by the City Council and will be enacted with one motion. Consider the following tort claims recommended for approval: Lillian Barton in the amount of $523.40 and Maurice Sleet in the amount of $5,000.00, and approve the resolutions authorizing the filing of a Friendly Suit and confessing judgment in said amount. 6. Consider the following tort claims recommended for denial: Jamie Gonzalez in the amount of $68,000.00, Edward Stalcup in the amount of $901.43, and Matthew and Jessica Richardson in the amount of $7,796.96. 7. Consider approving a resolution amending the City of Lawton FYE26 budget, as amended, to appropriate $66,331.39 in insurance proceeds to the General Fund and $4,538.34 in insurance proceeds to the Stormwater Fund for the repair of city facilities. 8. Consider approving a resolution creating Article A-19-8, Chapter A-19, Appendix A, Schedule of Fees and Charges, Lawton City Code, 2015, by adding a fee for locker rentals at the Lawton Aquatic Park. 9. Consider approving a resolution amending Appendix A, Schedule of Fees and Charges, Lawton City Code, 2015, pertaining to Article A-19-8, Chapter 19, Recreation, by adding a fee for Concession Stand items at the Lawton Aquatic Park. 10. Consider and take action approving Amendment No. 11 to the Master Services Agreement with Garver, LLC, in the amount not to exceed $1,394,500.00 for Professional Engineering Services to include additional bidding and construction services for SEWTP Dewatering improvements and SEWTP Force Main Improvements as two separate construction projects. 11. Consider and take action approving the plans, specifications and authorize advertisements for the construction of the SEWTP Dewatering Improvements (PU2414) and SEWTP Force Main Improvements (PU2422) projects for upgrades to the waste solids removal at the Southeast Water Treatment Plant. 12. Consider approving a partnership support agreement between the McMahon Auditorium Authority and the City of Lawton, subject to the McMahon Auditorium Authority also approving the agreement, to promote and foster tourism and economic development and make repairs to Arts and Humanities buildings. 13. Consider granting a 20-foot-wide overhead right-of-way easement to PSO across land owned by the City of Lawton located south of Lee Boulevard and east of McMahon Park and on the east side of Wolf Creek, and authorizing the Mayor to execute the document. 14. Consider approval of a task order for PW2503, 38th street rehabilitation from Gore Blvd to Lee Blvd to WSB for the management of the project. 15. Consider and take action in approving Change Order no. 1 increasing the contract by $200,000 and adding 65 days to the project time for the Map 9 Waterline Rehabilitation Project PU2308 due to quantity overruns that have affected the total cost of the project. The unit prices bid with the project rate will be used for the additional quantities. 16. Consider extending CL24-007 Manhole Coating Product to Ace Pipe Cleaning, INC of Kansas City, MO. 17. Consider extending contract CL25-011 Electrical Instrumentation and Control Services for Public Utilities to Worth Hydrochem of Oklahoma, Inc. 18. Consider approving an Agreement between the Lawton Economic Development Corporation (LEDC) and the City of Lawton, subject to approval by the LEDC, to fund activities designed to encourage, promote and foster economic/industrial development in the City of Lawton, and authorize the Mayor and City Clerk to execute the Agreement. 19. Consider and authorize the Mayor to sign a conflict of interest waiver agreement to waive any potential conflict with the firm McAfee & Taft, concerning the firm's representation of Sooner Lockwood LLC and Cache Road Partners LLC in negotiating a retail economic incentive, including a potential sales tax reimbursement agreement. 20. Consider the Scope of Work and approve a Professional Services Agreement with Westnet, LLC for $1,243,206.71 to install a new First-In Alerting System for all Lawton fire stations and authorize the Mayor to execute the agreement. 21. Consider and take action rejecting all bids received for the Gondola Lake Dam Improvements Project PU2411 and authorizing staff to re-advertise the contract for award. Only one bid was received however it was deemed non- responsive. 22. Consider approving Council Policy 7-5 that establishes quarterly reporting requirements for the Community & Housing Development Division. 23. Receive a traffic report and consider the installation of traffic-calming measures on SW 13th Street, between Dr Charles Whitlow Ave and SW Georgia Ave, and provide direction to staff as deemed necessary. 24. Receive a traffic report and consider the installation of traffic-calming measures on NW Faircloud, between NW 72nd Street and Creek Hollar Drive and provide direction to staff as deemed necessary. 25. Hold a public hearing and consider an Ordinance to amend the binding site plan for property located at 1503 NW Sheridan Road, Lawton, OK 73505. 33. Consider approving an ordinance modifying the title to Article 20-2, modifying Sections 20-2-202 through 20-2-207, 20-2-209, 20-2-210, and 20- 2-212, and creating Section 20-2-212.1, Article 20-2, Chapter 20, Lawton City Code, 2015 pertaining to excavating and/or boring within street rights-of-way or public easements including paving cuts by requiring a paving cut/excavation/boring permit for such work; providing for severability, codification and by separate vote, declare an emergency. 34. Consider approving an ordinance creating Division 6-6-3, Article 6-6, Chapter 6, Lawton City Code, 2015 by establishing that an excavation/boring contractor's registration is required to obtain a paving cut/excavation/boring permit; providing for severability, codification, and by separate vote, declare an emergency. 35. Consider approving a resolution amending Appendix A, Schedule of Fees and Charges, and Appendix B, Bond Schedule, Lawton City Code, 2015, pertaining to Article A-20-2, Chapter 20, Paving Cuts and Excavations, by adding a fee for boring permits under or within street rights-of-way or public easements; establishing a fee in Article A-6-6 pertaining to contractor’s registration by creating an annual and renewal fee for such registration; and establishing a surety bond amount for excavation/boring contractors by creating Article B-6-6-3-605. 36. Consider approving an ordinance modifying Sections 20-4-402, 20-4-403, and 20-4-405, Article 20-4, and rescinding Figure 1, Chapter 20, Lawton City Code, 2015 pertaining to Revocable Communications Cable and Pipeline Permit by updating where such permits are applied for and modifying that the revocable permit is for an indefinite term until said permit is terminated or revoked; providing for severability and by separate vote, declare an emergency. 37. Consider approving a resolution amending Appendix A, Schedule of Fees and Charges, Lawton City Code, 2015, pertaining to Article 20-4, Chapter 20, Revocable Communications Cable and Pipeline Permit, by modifying that the annual fee is a use fee and not a review fee and by establishing an inspection fee for any requested or required inspection outside of the initial construction. 38. Consider suspending approvals of new fiber installation from any company that has not submitted surveyed record as-built drawings for review and approval in accordance with their agreement/permit, and also consider rescinding any approvals for fiber installation that has yet to be installed until such time the required surveyed record as-built drawings have been submitted and approved. Executive Session 39. Pursuant to Section 307B.1, Title 25, Oklahoma Statutes, consider convening in executive session to review the employment of John Ratliff as City Manager, and in open session take other action as necessary. 40. Pursuant to 307B.3, Title 25, Oklahoma Statutes, consider convening in executive session to discuss the purchase or appraisal of real property needed for the US-62 Interchange at Goodyear Boulevard Project No. EN2104, and if necessary, take action in open session. 41. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss the pending action in the District Court of Comanche County titled Julie Magness v. City of Lawton, CJ-2023-410 and, if necessary, take appropriate action in open session. Adjournment The City of Lawton encourages participation from all of its citizens.
