To ensure compliance with the Oklahoma Open Meeting Act, the Mayor and Council will receive comments but will NOT engage in direct responses. To participate, speakers must submit a Request to Speak Form to the City Clerk and reside within the Lawton city limits. Each speaker is allotted 3 minutes, with a maximum of 9 minutes per topic, and Audience Participation is limited to 30 minutes total. Consent Agenda The following items are considered to be routine by the City Council and will be enacted with one motion. Should discussion be desired on an item, that item will be removed from the Consent Agenda prior to action and considered separately. 3. Consider the following tort claims recommended for denial: Jennifer and Carson Stringham in the amount of $3,075.00, and Joe Castillo in the amount of $5,200.00. 4. Consider the following tort claim recommended for approval: Intondi, John dba Patriot Air Solutions, in the amount of $544.08, and approve a resolution authorizing the filing of a friendly suit and confessing judgment in the said amount. 5. Consider adopting a resolution approving the joint petition settlement in the amount of $16,830.00 and making payment in the workers’ compensation claim of Timothy Romero. 6. Consider approving a resolution amending Resolution 24-182 by establishing an annual funding allocation for hotel/motel tax collections received by the City of Lawton. 7. Consider approving a resolution authorizing and calling for an election in the City of Lawton, State of Oklahoma, for the purpose of setting the dates for the 2025 primary and general municipal elections for designated City Council seats and authorizing the Mayor to issue an election proclamation. 8. Consider and take action approving the plans, specifications and authorize advertisement for the construction of the Gondola Lake Dam Improvements Project PU2411 to rehabilitate the existing dam structure. 9. Consider awarding contract CL25-026 Thermoplastic Material and Epoxy Primer/Sealer to Ennis Flint, Inc. of Greensboro, NC. 10. Consider approving a professional services agreement with the Center for Economic Development Law to provide the City with legal advice, consultation and representation in the area of economic development and other specific matters, as requested, and authorize the Mayor to execute the Agreement. 11. Consider approving the annual agreement between the Center for Creative Living Corporation and the City of Lawton for services to senior citizens in the amount of $15,844.00 and authorize the Mayor and City Clerk to execute the Agreement. 12. Consider approving the annual Agreement between Lawton Mobile Meals, Inc. and the City of Lawton for the specific purpose of preserving the health and welfare of homebound elderly and/or disabled citizens of Lawton, Oklahoma in the amount of $48,348.00, and authorize the Mayor and City Clerk to execute the Agreement. 13. Consider approving renewal of the master services retainer agreement for professional engineering services to Standard Engineering + Field Services, LLC for the purpose of providing full engineering services for the City of Lawton and authorize the Mayor and City Clerk to execute the contract. 14. Consider authorizing the Mayor and City Clerk to execute the FY-2026 Memorandum Agreement for real-time lake level monitoring of Lake Ellsworth and Lake Lawtonka between the City of Lawton, the Oklahoma Water Resources Board and the U.S. Geological Survey and authorize paying of the city's portion of cost. 15. Consider approving a resolution amending the City of Lawton FY25 budget, as amended, by appropriating $31,651.47 in insurance proceeds to the General Fund for payment to the McMahon Auditorium Authority for the repair of weather-related damages to arts and humanities buildings. 16. Consider approving an amendment to the fiscal year 2025 Partnership Support Agreement with McMahon Auditorium Authority. 17. Consider authorizing the Mayor to execute an application for Eligibility for the Federal Property Donation Program to Receive Federal Surplus Property from the Oklahoma Office of Management & Enterprise Services. 18. Consider approving appointments to boards and commissions. 19. Consider approving the minutes of the May 20, 2025 Special City Council Meeting and May 27, 2025 Regular City Council Meeting. Business Items 20. Consideration and action upon a resolution of the City of Lawton, Oklahoma, (the “City”) approving and authorizing the incurring of indebtedness by the trustees of the Lawton Industrial Development Authority (the “Authority”) to be accomplished by the issuance of its Sales Tax Revenue and Refunding Bonds, Series 2025A or other evidences of indebtedness in one or more series either in these series names or others determined as needed on a tax-exempt or taxable basis, at a premium or discount, in the aggregate principal par amount of not to exceed One Hundred Thirty Million and No/100 Dollars ($130,000,000) for the purpose of financing all or a portion of the costs of acquisition, construction, equipping, renovating and improving certain streets and capital improvement projects for the benefit of the City and for the purpose of refunding a portion of the outstanding indebtedness of the Authority that financed all or a portion of the cost of the acquisition, construction, equipping, renovating, and improving of certain capital improvement projects for the benefit of the City and Sales Tax Revenue Refunding Bonds Taxable Series 2025B or other evidences of indebtedness in one or more series either in these series names or others determined as needed on a tax-exempt or taxable basis, at a premium or discount, in the aggregate principal par amount of refunding taxable bonds of not to exceed Twelve Million and No/100 Dollars ($12,000,000.00) (together, the “Bonds”) for the purpose of refunding a portion of the outstanding indebtedness of the Authority that financed all or a portion of the cost of the acquisition, construction, equipping, renovating, and improving of certain capital improvement projects for the benefit of the City; and pay costs of issuance related thereto; providing that the organizational document creating the Authority is subject to the provisions of the Bond Indenture authorizing the issuance of said Bonds; approving the award of the sale of said Bonds on a negotiated basis, approving the waiver of competitive bidding with regard to the sale of said Bonds; and approving the proceedings of the Authority pertaining to the sale of said Bonds; approving and authorizing a sales tax agreement (the “Sales Tax Agreement”) by and between the City and the Authority pertaining to a year-to-year pledge of certain sales tax revenues; and all matters related thereto, including execution of all related documents thereto. 21. Consider receiving a presentation regarding the upcoming Firehawk Aerospace project and direct staff to initiate the rezoning process to change the zoning from A-1 to I-4 for the 320-acre tract of land located west of Goodyear Blvd/97th Street and north of what would be W Gore Blvd. 22. Hold a public hearing and consider an ordinance for a rezoning request from Tooth Turf, LLC to change the zoning from the R-1, Single-Family Dwelling District to P-O, Professional and Office District zoning classification for property located at 311 NW Sheridan Road, Lawton, OK 73505 and take appropriate action as deemed necessary. 23. Hold a public hearing and consider a resolution for an amendment to the 2030 Land Use Plan requested by Arkeketa Enterprises, Inc to change the Land Use Plan from Residential/High Density to Commercial for the properties located at 2102 SW A Avenue & 2101 SW B Avenue, Lawton, OK, 73501 and take appropriate action as deemed necessary. 24. Hold a public hearing and consider an ordinance for a rezoning request from Arkeketa Enterprises, Inc to change the zoning from the R-4 High-Density Apartment District to C-1 Local Commercial District zoning classification for the properties located at 2102 SW A Avenue & 2101 SW B Avenue, Lawton, OK, 73501 and take appropriate action as deemed necessary. 25. Consider discussing site plan deficiencies related to the property located at 1 NW Fort Sill Boulevard and determining whether the binding site plan should be modified per the process outlined in City Code. 26. Consider approving the 2025 Kids First: Homeless Action Plan for the City of Lawton. 27. Consider approving an Ordinance pertaining to Food & Food Service Establishments by amending Sections 12-1-103, 12-1-104, and 12-1-108, Article 12-1, Chapter 12, Lawton City Code, 2015, by adding the permit requirement for temporary mobile food-service establishment, setting the expiration date for this permit at 30 calendar days after issuance, providing for severability and establishing an effective date. 28. Consider approving a Resolution amending Appendix A, Schedule of Fees and Charges, Lawton City Code, 2015, pertaining to Chapter 12, Food & Food Service Sanitation, by amending Article A-12-1 and establishing an effective date. 29. Consider a Resolution approving the trust indenture creating the Lawton Unhoused Trust Authority; providing for appointment of the initial trustees; setting forth the purposes of the trust, the trust estate, and powers of the trustees; authorizing the acceptance of the beneficial interest of the trust by the beneficiary, the City of Lawton; making any floor amendments Council deems necessary; and authorizing the execution of the trust indenture as appropriate. 30. Discuss Ordinance No. 25-19 and Resolution No. 25-111, which eliminated landfill fee exemptions, ended reduced rates, and established a state-mandated fee, and take action as deemed necessary. 31. Consider approving a resolution declaring by two-thirds majority vote of the City Council that an emergency exists pursuant to Paragraph "A" of 61 O.S. Section 130 of state law and Paragraph "A" of Section 10-1-113 of City Code due to conditions resulting from a sudden unexpected happening or unforeseen occurrence or condition and situation wherein the public health or safety is endangered due to recent storm damage caused to the City's landfill; directing staff to take steps necessary to repair the damaged areas; and further waiving competitive bid requirements with regard to notice and bids. Executive Session 32. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss the status of an ongoing investigation concerning CDBG funds and other Housing Division related matters, and if necessary, take appropriate action in open session. 33. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss a pending claim for potential litigation involving Sabrina Turner stemming from an incident involving a former City of Lawton Correctional Officer and, if necessary, take appropriate action in open session. 34. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss the pending action in the District Court of Comanche County titled City of Lawton, Oklahoma, A Municipal Corporation vs. Transforming Hand, Inc, et al, Case No. CJ-2025-265. and if necessary, take appropriate action in open session.
